GENERAL CONDITIONS

These general conditions govern the rights and obligations relating to the use of the services offered on the website www.dadashome.ch

ARTICLE 1 : CHAMP D'APPLICATION

1.1. These general terms and conditions of sale are intended to govern the relations between:

• (i) Mr Davide D'Agostino, operating the limited liability company for online trading/sales under the trade name DADA'S HOME, Rue du Prado 3 – 3963 Crans Montana, Switzerland.
• (ii) Any Internet user using the Site (the “Internet User”) and designated as:

● Buyer if the Internet user purchases one or more items online on the Site.

1.1 The Internet user accepts these general conditions, as well as any subsequent modifications, each time he connects to and browses the Site.

1.2 DADA'S HOME reserves the right to modify these general conditions at any time and to replace the old version with the most recent version on the Site each time.

ARTICLE 2: USE OF THE SITE

2.1. There is no right to use the Site or claim to the services of Dada's home. In particular, Dada's home may at any time exclude an Internet user, in particular in the event of a violation of these general conditions.

2.2. By using the services offered by the Site, in particular by purchasing items offered for sale on the Site, the Buyer confirms that he or she is a natural person of at least 18 years of age and exercising civil rights. Minors (under 18 years of age) may not purchase items on the Site.

ARTICLE 3: PROTECTION OF PERSONAL DATA

3.1. DADA'S HOME undertakes not to infringe on the privacy of Internet users and the confidentiality of the information provided.

3.2. The mandatory or optional nature of the data to be provided is indicated when they are collected.

3.3. This data collection takes place in particular when purchasing an item and contacting DADA'S HOME 41 (0) 275659005 or info@dadashome.ch.

3.4. The personal data requested by DADA'S HOME are necessary to ensure proper management of purchases made by Internet users via the Site, as well as to improve the quality of the service provided by DADA'S HOME.

3.5. The Internet user accepts that DADA'S HOME retains all documents, information and records concerning his activity on the Site, in particular through the use of cookies.

ARTICLE 4: CONCLUSION OF A SALE

4.1. The sale is concluded once the Buyer has validated his purchase and a confirmation has been sent to him by email.

Upon confirmation, the sale is concluded and deemed complete.

A. Payment of the order

4.2. The Buyer may pay:

• (i) by bank card (Mastercard, Visa, American Express),
• (ii) on PayPal

4.3. The collection of the Buyer's bank card information is ensured by the platform (secure payment by nets.eu). The backup of this information is done in any case with the Buyer's consent, on the server of [Server name]. Under no circumstances does DADA'S HOME store or have access to the Buyers' bank details. Payments made are secured by a data encryption procedure in order to prevent the interception of this information by a third party.

4.4. DADA'S HOME reserves the right not to offer certain payment methods and to refer to other available payment methods. In such a case DADA'S HOME is not required to provide reasons for its decision.

B. Delivery of the item

4.5 DADA'S HOME assumes responsibility for the proper execution of the obligation to deliver the ordered item.

4.6. Once the Buyer has confirmed his order online and DADA'S HOME has collected payment of the sale price, DADA'S HOME ensures delivery of the items by delivering the item to the Buyer within 72 hours if the Buyer resides in the Canton of Valais.

4.7. For Buyers providing a delivery address in a Swiss canton other than the canton of Valais, DADA'S HOME will send the items ordered by post.

4.8. DADA'S HOME uses the DHL shipping service for all orders placed by Buyers indicating an address not in Switzerland.

4.9. For any sending of an item to a Buyer by Post, DADA'S HOME undertakes to send it suitably packaged.

4.1o. DADA'S HOME also ensures that any package whose value exceeds the amount of CHF 500.- is sent with the additional "registered" service.

4.11. DADA'S HOME keeps proof of shipment of the package for the month following the shipping date.

4.12. In the event that the Buyer has not received their package, it is up to DADA'S HOME to file a complaint with the Post Office.

C. Return of a sold item

4.13 In accordance with Article 6, the Buyer has a period of 14 days from the date of ordering the item to inform DADA'S HOME whether he wishes to return the purchased item and request a refund. If the Buyer does not confirm his wish to return the purchased item within 14 days from the date of ordering it, he is deemed to have accepted the item as is. No return or refund is possible after this period.

Sale items cannot be returned or exchanged.

ARTICLE 5: “SATISFIED OR REFUNDED” RIGHT

DADA'S HOME grants the Buyer a "Satisfied or Refunded" right according to the conditions of this article.

A. Right of return

5.1 Dada's home grants the Buyer the right to return the item ordered within 14 days if he is not satisfied with it, provided that the item is returned as is as sent and that the item is not on sale.

5.2. After the 14-day period, the Buyer will no longer be able to benefit from this “Satisfied or Refunded” right and no return or refund is possible.

B. Returning the item to DADA'S HOME

5.3. In the event of a return of the item, the Buyer must return it directly to DADA'S HOME.

5.4. The Buyer must return the item, in perfect condition, using the services of the Swiss Post by mail with the additional "signature" service at his expense (registered mail), to Dada's home. The item must have been carefully packaged. The return of the item is the responsibility of the Buyer.

5.5 The Buyer must ensure that any package whose value exceeds the amount of CHF 1500.- is shipped with the additional service "insurance". If the value exceeds the amount of CHF 5000.- the Seller must take out transport insurance with an insurance company.

5.6. Return costs are the responsibility of the Buyer.

5.7. In the event of a return in accordance with the paragraphs above, the price paid for the item will be refunded to the Buyer on the credit card used on the site.

5.8. The Buyer agrees that only an amount equal to the price of the item will be reimbursed, excluding any other amount or interest.

ARTICLE 6: MISCELLANEOUS PROVISIONS

6.1. The fact that Dadas' home tolerates any actions contrary to these general conditions cannot be considered a waiver on its part to avail itself of said general conditions.

6.2. In the event that one or more of the provisions of these general conditions are set aside by a legislative or regulatory provision or by a court decision, all other provisions shall remain applicable.

6.3. By browsing the Site, the Internet user acknowledges having read, understood and accepted without reservation all of these general conditions which govern with binding force all relations between Dada's home and the Buyers.

6.4 These general conditions form an integral part of the sales mandate concluded between Dada's home and the Seller.

6.5. Dada's home may modify these general terms and conditions according to the evolution of its offer and the market. Each party therefore undertakes to regularly consult the general terms and conditions published on the Site to be aware of any changes made to them.

6.6. The site, its content, its catalogue, its texts, its illustrations, its photographs and images are the property of Dada'shome and/or third parties contractually linked to Dada's home, holders of the intellectual property rights of the site. It is forbidden to reproduce, represent and/or exploit all or part of the site, its content, its catalogue, its texts and illustrations.

ARTICLE 7: APPLICABLE LAW AND JURISDICTION

7.1. All disputes relating to these general conditions between Dada's home and the Buyer are subject exclusively to Swiss law, to the exclusion of conflict rules.

7.2. The settlement of disputes falls exclusively within the jurisdiction of the courts of the canton of Valais.
